Terms of Service

1. Acceptance of Terms

By accessing or using PayBild ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users, including homeowners and contractors ("Pros").

2. Eligibility

You must be at least 18 years of age to use PayBild. By creating an account, you represent that you are 18 or older and have the legal capacity to enter into binding contracts. Use of the Platform by anyone under 18 is strictly prohibited.

3. Description of Service

PayBild is a platform that connects homeowners with licensed contractors for home improvement projects. PayBild facilitates project posting, contractor matching, proposal submission, contract creation, and milestone-based payment tracking. PayBild is not a party to any contract between homeowners and Pros and does not guarantee the quality or completion of any work.

4. Pro Responsibilities

All Pros using PayBild represent and warrant that they:

  • Will accurately represent their credentials, experience, and qualifications
  • Will perform all work in a professional and workmanlike manner
  • Are legally authorized to work in the United States

In addition, licensed contractors and specialty trade Pros represent and warrant that they:

  • Hold all required licenses and permits for the work they perform
  • Carry valid general liability insurance and, where required, workers compensation insurance

PayBild may verify license and insurance information through third-party services. Providing false or misleading information is grounds for immediate account termination.

5. Project Owner Responsibilities

Not everyone using PayBild on the homeowner side will be a traditional homeowner - and that is by design. PayBild welcomes anyone with the legal authority to commission work on a property. This includes:

  • Homeowners acting on their own behalf
  • Tenants who have written permission from their landlord to authorize the work in question
  • Property managers and management companies who hold fiduciary responsibility to the property owner and are authorized to commission improvements on their behalf
  • Businesses and commercial entities authorized to contract for work on a property they own, lease, or manage

Regardless of your relationship to the property, by using PayBild as a Project Owner you represent that you have the legal authority to authorize and fund the work being commissioned. You agree to provide accurate project descriptions and to communicate clearly and in good faith with your selected Pro. Misrepresenting your authority over a property is a violation of these terms.

6. Payments and Escrow

PayBild uses milestone-based payments. Funds are held in escrow and released upon Project Owner approval of each milestone. When a dispute arises between a Project Owner and a Pro, PayBild facilitates structured mediation using the documentation on record - GPS photos, milestone approvals, platform communications, and timestamps. All payment processing is subject to the terms of PayBild's payment processing partners.

7. Affiliate Program

PayBild's affiliate and referral program rewards you for growing the PayBild community. Referral rewards are earned when a referred user completes a qualifying action as defined at enrollment. PayBild reserves the right to withhold rewards only where referrals are found to be fraudulent or in clear violation of these terms - legitimate referrals are always honored.

8. Off-Platform Activity - Loss of Protections

Contacting a Pro or Homeowner outside the PayBild platform voids all platform protections including escrow rights, dispute resolution access, milestone approval records, and payment guarantees. PayBild is a payment protection platform, not a contractor directory. Profile visibility is intentionally limited - Homeowners see Pro trade, ZIP, and verified badge only until escrow is funded. Full details are disclosed on the signed project estimate only. Any project activity, communication, payment, or agreement that occurs outside the PayBild platform is not covered by PayBild escrow, dispute resolution, or any platform guarantee. PayBild bears no liability for any transaction or agreement made off platform.

9. Prohibited Conduct

You agree not to:

  • Post false, misleading, or fraudulent information
  • Circumvent the Platform to conduct transactions off-platform to avoid fees
  • Harass, threaten, or discriminate against other users
  • Use the Platform for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Platform
  • Upload content to your BragBook or profile that is not your own work, contains third-party branding, or misrepresents your capabilities

10. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. PayBild does not warrant that the Platform will be uninterrupted, error-free, or that any contractor is properly licensed, insured, or qualified. You use the Platform at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, PayBild shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to damages arising from contractor work performed through the Platform.

12. Termination

PayBild reserves the right to suspend or terminate any account at any time for violation of these terms or for any conduct deemed harmful to the Platform or its users.

13. Governing Law

These Terms of Service are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Idaho.

14. Changes to Terms

PayBild may update these terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised terms.
